By accessing PipkinRated.com, you agree to these terms. If you do not agree, do not use the site.

Rating Opinion Doctrine

All Pipkin Ratings, scores, status tier designations, and associated commentary are expressions of independent professional opinion based on a published, standardized evaluation methodology. They are not statements of fact, warranties, guarantees of performance, or endorsements. Pipkin Ratings are not intended to be relied upon as the sole basis for deployment decisions, investment decisions, legal decisions, or any other consequential action. Users should conduct independent due diligence in addition to reviewing Pipkin Ratings.

This opinion doctrine applies to all ratings published by Pipkin Ratings LLC, whether free or paid, preliminary or final, initial or retest. The methodology underlying each rating is published at pipkinrated.com/framework and is available for independent review.

1. Nature of Ratings

Pipkin ratings are expressions of independent opinion based on documented, standardized methodology. They represent the professional judgment of Pipkin Ratings LLC applied through the Pipkin Framework v0.1 and its subsequent versions.

Ratings are not guarantees of performance, safety, suitability, or fitness for any particular purpose. A Pipkin rating reflects the evaluated agent’s performance against the Standard Core Battery at the time of evaluation. Agent behavior may change following evaluation due to updates, modifications, or changes in operating conditions.

Pipkin ratings are protected speech under the First Amendment of the United States Constitution, consistent with the legal protections afforded to other rating agencies including, but not limited to, credit rating agencies recognized by the SEC.

2. Use of Published Ratings

Published Pipkin ratings, scores, and status tiers may be referenced, cited, and discussed in editorial, journalistic, academic, and internal business contexts with proper attribution to Pipkin Ratings LLC and PipkinRated.com.

The Pipkin trust badge design, the “PIPKIN RATED” mark, and the composite visual identity of the badge are proprietary to Pipkin IP LLC. Display of the trust badge by rated entities is subject to the terms of the Badge Usage Agreement provided upon certification.

Commercial use of Pipkin ratings data beyond reference and citation — including but not limited to integration into software products, automated retrieval, or redistribution — requires an Enterprise API subscription.

3. Evaluation Services

Evaluation fees cover the cost of conducting the evaluation using the Pipkin Framework. Payment does not guarantee any particular outcome, rating, status tier, or score. The evaluation fee is non-refundable once the evaluation has commenced.

All evaluation results are published on PipkinRated.com unless otherwise specified in writing under an Enterprise Private Evaluation agreement. Developers receive a 5-day factual accuracy check to flag factual errors only — such as a deprecated version tested or a misidentified capability. The score itself is never disclosed prior to publication. There is no negotiation. The developer and the public see the score at the same moment.

Submission of an agent for evaluation constitutes agreement to the Client Scope Agreement, which governs the evaluation relationship in full.

4. Re-Test Policy

Developers may request up to three (3) re-tests per rating cycle at 50% of the original evaluation fee. A minimum of 14 days must elapse between re-test attempts. Each re-test uses a different test form from the Standard Core Battery to prevent memorization. The best score per pillar across all attempts is retained as the published score.

After three re-tests, a 12-month waiting period applies before the next evaluation cycle. Disqualifying conditions identified during any attempt remain on the agent’s permanent record regardless of subsequent re-test results.

5. Intellectual Property

All content on PipkinRated.com, including but not limited to the Pipkin Framework, the Pipkin Injection Suite, the Standard Core Battery, scoring rubrics, evaluation report formats, the Pipkin trust badge design, and the PIPKIN and PIPKIN RATED marks, are the intellectual property of Pipkin IP LLC.

The Pipkin Framework methodology is published for transparency purposes. This publication does not constitute a license to use, reproduce, or create derivative works from the methodology for commercial evaluation purposes without written permission from Pipkin IP LLC.

6. Disclaimer of Warranties

ALL CONTENT, RATINGS, AND SERVICES ON PIPKINRATED.COM ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. PIPKIN DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. USERS SHOULD CONDUCT THEIR OWN DUE DILIGENCE IN ADDITION TO CONSULTING PIPKIN RATINGS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PIPKIN RATINGS LLC, PIPKIN IP LLC, PIPKIN HOLDINGS LLC, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE USE OR INABILITY TO USE PIPKIN RATINGS, THE SITE, OR ANY EVALUATION SERVICES, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF PIPKIN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL PIPKIN’S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY THE USER FOR EVALUATION SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE THOUSAND DOLLARS ($1,000), WHICHEVER IS LESS.

8. Indemnification

You agree to indemnify, defend, and hold harmless Pipkin Ratings LLC, Pipkin IP LLC, Pipkin Holdings LLC, and their respective officers, directors, members, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the site, your violation of these terms, or your infringement of any intellectual property or other rights of any person or entity.

9. Dispute Resolution

Developers who believe a rating contains factual errors may submit a written dispute within 30 days of publication. Disputes must identify the specific factual error and provide supporting evidence. Methodological disagreements and subjective interpretations are not grounds for dispute.

Pipkin will review disputes within 15 business days and issue a written determination. If a factual error is confirmed, Pipkin will correct the rating and publish an amended report. If the dispute is not upheld, the original rating stands and the determination is final.

Rating Dispute Process

The following formal process governs all disputes related to published Pipkin Ratings:

Step 1: Developer submits a written dispute to evaluations@pipkinrated.com within 30 days of publication. The dispute must identify specific factual errors with supporting evidence.

Step 2: Pipkin acknowledges receipt within 5 business days.

Step 3: Pipkin reviews the disputed findings within 15 business days. Review is conducted by the original evaluator and, where available, one additional reviewer.

Step 4: Possible outcomes: (a) Factual error confirmed — rating is corrected and republished with amendment notice; (b) Dispute not upheld — original rating stands, determination is final; (c) Partial correction — specific findings corrected, composite score recalculated if materially affected.

Step 5: All disputes and outcomes are documented in the agent’s permanent file. The dispute itself is not published unless the developer requests it.

Note: Methodological disagreements and subjective interpretations of scores are NOT grounds for dispute. Disputes must cite specific, verifiable factual errors in the evaluation data.

10. Governing Law and Jurisdiction

These terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law provisions. Any legal action or proceeding arising out of or related to these terms or the use of PipkinRated.com shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of such courts.

11. Modifications

Pipkin reserves the right to modify these terms at any time. Changes will be posted on this page with an updated “Last updated” date. Continued use of PipkinRated.com after modifications constitutes acceptance of the revised terms. Material changes will be communicated to registered users via email.

12. Severability

If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Privacy Policy

Pipkin Ratings LLC (“Pipkin,” “we,” “us”) is committed to protecting the privacy of visitors to PipkinRated.com and users of our services. This policy describes what data we collect, how we use it, and your rights regarding that data.

1. Data We Collect

We collect only the following personal data:

  • Email addresses — submitted voluntarily through newsletter signup forms, evaluation inquiry forms, enterprise contact forms, and general contact forms.
  • Names and company information — submitted voluntarily through evaluation request and enterprise inquiry forms.
  • Agent information — technical details about AI agents submitted for evaluation, provided by the submitting party.

We do not collect data passively. We do not use tracking cookies, pixel tags, browser fingerprinting, or any form of behavioral tracking technology.

2. Data We Do Not Collect

  • We do not use Google Analytics or any third-party analytics platform.
  • We do not set advertising or tracking cookies.
  • We do not use social media tracking pixels.
  • We do not collect IP addresses for tracking purposes.
  • We do not build user profiles or behavioral models.
  • We do not participate in ad networks or data exchanges.

3. How We Use Your Data

Personal data submitted to Pipkin is used exclusively for the following purposes:

  • Delivering The Pipkin Brief newsletter to subscribers
  • Responding to evaluation inquiries and enterprise requests
  • Communicating evaluation status updates to clients
  • Sending service-related notices (rating publication, re-test results, expiration warnings)

We do not use personal data for marketing purposes beyond the specific service the user signed up for. Newsletter subscribers receive only the newsletter. Evaluation clients receive only evaluation-related communications.

4. Data Sharing

We do not sell, rent, trade, or share personal data with third parties for marketing or advertising purposes. We may share data only in the following limited circumstances: (a) with service providers who process data on our behalf under binding data processing agreements (e.g., email delivery service); (b) when required by law, regulation, legal process, or enforceable governmental request; (c) to protect the rights, property, or safety of Pipkin, our users, or the public.

5. Data Storage and Security

Personal data is stored using industry-standard encryption at rest and in transit (TLS 1.2+). Data is hosted on infrastructure located in the United States.

Data is retained only as long as necessary to fulfill the purpose for which it was collected. Newsletter subscriber emails are retained until the subscriber unsubscribes. Evaluation client data is retained for seven (7) years in accordance with our record retention policy.

6. Your Rights

Regardless of your location, you have the following rights regarding your personal data:

  • Right to access — request a copy of the personal data we hold about you.
  • Right to rectification — request correction of inaccurate or incomplete personal data.
  • Right to erasure — request deletion of your personal data, subject to legal retention requirements.
  • Right to data portability — request your data in a structured, machine-readable format.
  • Right to object — object to processing of your personal data for specific purposes.
  • Right to withdraw consent — withdraw consent at any time by unsubscribing from communications or contacting us.

To exercise any of these rights, contact privacy@pipkinrated.com. We will acknowledge your request within 10 business days and respond substantively within 30 days.

7. For European Economic Area Residents (GDPR)

If you are located in the European Economic Area, the United Kingdom, or Switzerland, the following additional provisions apply:

  • Legal basis for processing: We process personal data based on consent (newsletter signup) and legitimate interest (responding to inquiries, fulfilling evaluation contracts).
  • Data controller: Pipkin Ratings LLC, Arizona, United States.
  • International transfers: Your data is transferred to and processed in the United States. We rely on Standard Contractual Clauses (SCCs) as the legal mechanism for such transfers.
  • Supervisory authority: You have the right to lodge a complaint with your local data protection authority.

8. For California Residents (CCPA/CPRA)

If you are a California resident, the following additional provisions apply under the California Consumer Privacy Act and California Privacy Rights Act:

  • Categories of PI collected: Identifiers (email address, name). No sensitive personal information is collected.
  • Sale of personal information: We do not sell or share personal information as defined under the CCPA/CPRA.
  • Right to opt-out: Because we do not sell personal information, there is no sale to opt out of. You may unsubscribe from communications at any time.
  • Non-discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights.

9. Email Communications (CAN-SPAM)

All commercial emails from Pipkin comply with the CAN-SPAM Act. Every email includes: the identity of the sender (Pipkin Ratings LLC), a valid physical postal address, and a clear mechanism to unsubscribe. Unsubscribe requests are processed within 10 business days.

We do not use deceptive subject lines, false header information, or misleading sender identities.

10. Children’s Privacy

PipkinRated.com is not directed at children under 16 years of age. We do not knowingly collect personal data from children under 16. If we become aware that we have collected personal data from a child under 16, we will delete that data promptly. If you believe a child has provided us with personal data, contact privacy@pipkinrated.com.

11. Changes to This Policy

We may update this privacy policy from time to time. Changes will be posted on this page with an updated date. Material changes will be communicated to registered users via email prior to taking effect.
